Heard Mr. Karnik, learned Advocate for Applicant and Ms. Kandharkar, learned Special Counsel for Respondent. 2.
By filing the present Interim Application, Applicant seeks modification of twin conditions i.e. clause Nos. (iv) and (v) of the bail order 14.02.2025 which is appended at page Nos. 8 to 23 of the Interim Application.

Ms. Kandharkar, learned Special Counsel has vehemently opposed the Interim Application.

Mr. Karnik would submit that Applicant desires to undertake treatment outside Maharashtra and hence for that he has to travel outside Maharashtra and the condition in clause (iv) is onerous.

As far as condition No. (iv) is concerned, Applicant has to follow the said condition and ensure that he takes prior permission if he has to travel for treatment. If he makes any such Application to the trial Court, the trial Court shall deal with it expeditiously in accordance with law. There is no merit in the said Application seeking modification or deletion of condition contained in clause (iv). Said prayer is therefore rejected.

In so far as condition clause No. (v) is concerned, Mr. Karnik informs the Court that passport of the Applicant is already confiscated and seized and lying with the Enforcement Directorate in Mumbai in some other case. If that is the position, as and when the Applicant receives his passport, the said condition shall be complied by him.
