This is an Application received from Jail on 30.04.2024. It has been listed for the first time after the directions to the Registry to list the pending matters received through Jail. It is seen that Applicant is arrested in a crime under Section 302 of the Indian Penal Code, 1860 and he is incarcerated for the past 7 years 7 months and 16 days since his date of arrest.

Issue notice to the Respondents. Mr. Pethe, learned APP waives service on behalf of Respondent-State. Learned APP is directed to take a copy of the Application from the Court record by approaching registry.

Mr. Pethe, learned APP would submit that trial has commenced and 4 prosecution witnesses are already examined. Considering the long incarceration of the Applicant, learned APP is directed to take appropriate instructions from the concerned Investigating Officer about the precise status of the trial and apprise the Court on the next adjourned date. Learned APP is further directed to place on record a copy of the chargesheet. 5.
Considering the above position, the High Court Legal Services Committee of this Court is hereby directed to appoint Mr. Sagar Joshi learned Advocate and Counsel practicing in this Court (Mobile No.9820719574) to represent and espouse the cause of Applicant through the Legal Aid and give his appointment letter to that effect.

Registry is directed to provide copy of the present Application to appointed Advocate Mr. Joshi within a period of one week from today.

The appointed Advocate on behalf of Applicant is directed to peruse the papers and to be ready to address the Court on the next
adjourned date. After hearing, present Application shall be decided by this Court.
