By this application, the applicant is seeking suspension of sentence and bail during the pendency of appeal filed by the applicant. 2.

The applicant has been convicted for offences punishable under Section 509 of the Indian Penal Code 1860 (for short "IPC") read with Section 67 and 67A of the Information Technology Act, 1961 and sentenced to suffer 3 months simple imprisonment and pay fine of Rs.1000/-.

It is the contention of learned counsel for the applicant that the is suffering from locomotor disability and is diagnosed with 'left sided hemiparesis due to stroke' and has 41% disability. The applicant was on Digitally signed by SHUBHADA SHANKAR KADAM Date:

2025.03.17 10:41:32 +0530 bail during trial and he has not misused the liberty. Hence, requested to SHUBHADA SHANKAR KADAM allow the application.

The learned APP for respondent-State strongly objected to allow the application.

I have heard both learned counsel.

The sentence imposed on applicant is short term sentence. The applicant is suffering from locomotor disability and is diagnosed with 'left sided hemiparesis due to stroke' and has 41% disability. During the trial, the applicant was on bail and he has not misused the liberty. It may take time to dispose of the appeal.

In view of above, the applicant's sentence is suspended and he is enlarged on bail, pending the hearing and final disposal of the appeal, on the following terms and conditions.

ORDER

i. The applicant be enlarged on bail on furnishing P. R. Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

ii.

The bail bond to be furnished before the Trial Court. Interim Application stands disposed of.
