This application is filed for relaxation of condition no. (d) in the order while granting bail vide order dated 1st February 2023.

Learned counsel for the applicant submits that though charge is framed, the trial has not yet commenced. He submits that the applicant is regularly attending the police station as per the condition imposed while granting bail. Learned APP submits that the applicant be directed to attend all the dates in the trial court.

Considering that the trial has still not commenced and charge is already framed, the applicant can be directed to attend all the dates in the trial court. Hence, condition no. (d) of order dated 1st February 2023 is modified by the following condition :

(d) Applicant shall attend all the dates in the trial court regularly unless exempted by written order passed by the court.

All other conditions imposed by order dated 1st February 2023 shall continue to operate and shall be binding on the applicant.

It is further clarified that if the applicant commits breach of any of the conditions, the prosecution would be entitled to apply for cancellation of bail.
