This is an Application for condonation of delay of 1 year & 118 days in filing the Appeal against the judgment and order dated 2.9.2023 passed by the Special Judge, Mangaon, District-Raigad in Special Atrocity Case No.1/2017.

Respondent No.1-State and Mr. Sushan Mhatre, learned counsel for the Respondent No.2.

Learned counsel for the Applicant submitted that after the judgment was pronounced, the Applicant was taken in custody. His family resides in a remote village and, therefore, he could not get in touch with his family and could not make an arrangement to file Appeal immediately. He is from a poor financial background and, therefore, he had to file his Appeal with the help of Legal Services Authority of this Court. She further submitted that though his age is shown as 70 years in the judgment, she has seen the Aadhaar Card of the Applicant and his age as of today is 81 years.

Learned counsel for the Respondent No.2 left it to the discretion of the Court in the interest of justice. Similarly learned APP does not have serious objection for condoning the delay.

Therefore, in the interest of justice and on the basis of the submissions made by learned counsel for the Applicant, the delay can be condoned. Hence, the following order:

:: O R D E R ::

i.

The delay of 1 year & 118 days caused in filing the Appeal is condoned.

ii.

The Appeal be processed further.

iii.

Interim Application is disposed of accordingly. (SARANG V. KOTWAL, J.)
