Heard Mr. Pradeshi, learned Advocate for the Applicant and Mr. Chate, learned APP for State.

Applicant/Accused was ordered to be released on bail by order dated 22nd July, 2024 passed in Criminal Bail Application No. 2276 of 2024. Bail Conditions are at paragraph 4 (i) to (viii) of the said order.

Dr. Pardeshi, learned Advocate for the Applicant states that by the present Application, the Applicant is seeking following prayer :

"1.

That the modification of the bail condition imposed in Criminal Bail Application No. 2276 of 2024 dated 22 July Talwalkar

21.IA930.2025.odt 2024 be granted, by permitting the Applicant to furnish cash bail in lieu of the solvent surety be allowed." 4.

Dr. Pardeshi, states that the Applicant be permitted to furnish cash bail to secure release of the Applicant. He states that the Applicant has instructed him to make a statement that regular surety as ordered by this Court would be furnished within 4 weeks from his release. Statement made by Dr. Pardeshi, learned Advocate on instructions from the Applicant is accepted. 5.

Dr. Pardeshi, learned Advocate for Applicant states that all the other conditions imposed by this Court in its order dated 22nd July 2024 passed in Bail Application No. 2276 of 2024 shall be abided by the Applicant.

It is disturbing to note that though the Applicant was released on bail by order dated 22nd July, 2024, this application is placed before this Court, almost after 11 months. Consequences of the same, is Applicant's continuation in jail. 7.

Applicant is permitted to furnish cash bail in the sum of Rs. 25,000/- in lieu of solvent sureties. Applicant to furnish solvent sureties within four weeks from his release from the jail. 8.
