The Court of Additional Sessions Judge - Greater Mumbai has refused to discharge this Applicant as per the order dated 10th January 1/3
2022. He has engaged an Advocate to file proceeding before this Court. In fact the Application was also affirmed before the Notary on 20th February 2023. However, earlier Advocate has not filed in time. Learned APP opposed the prayer. The reasons for condonation of delay are mentioned in Para No.2. They are sufficient reasons. 4.
In view of that, the Application is allowed in terms of prayer clauses (a) and (b). The delay is condoned. The Revision Application be numbered.
CRIMINAL REVISION APPLICATION (ST) NO.4912 OF 2025 5.
Heard learned Advocate for the Applicant whose prayer for discharge is rejected on 10th January 2022. The allegation against him is he has accompanied the victim to the hospital. According to the learned Advocate for the Applicant, absolutely there is no material. 6.
Learned APP is served with a soft copy by Office today only. She needs to go through the papers to point out the Court which are the relevant materials. On the next date, she can point out the relevant materials. This Court is also required to go through the order passed by this Court while discharging the co-accused.
