Heard Mr. Dhokale, learned Advocate for Applicant and Mr. Kulkarni, learned APP for State.

Applicant before me was enlarged on bail by order dated 21.01.2025 in Bail Application No. 2080/2024. Present Application is filed for relaxing condition No. (iii) of the said order to the extent of allowing the Applicant to enter the jurisdiction of Mumbai Suburban District to visit his house in Vikhroli for a period of 13 days for the purpose of performing last rites of his wife who has unfortunately expired on 03.03.2025. Though the Applicant seeks to visit his house from 05.03.2025 to 17.03.2025, matter is mentioned before me today

at the time of rising as it has not reached hearing due to paucity of time. Considering the urgency in the matter, present Application is taken up for urgent hearing.

It is seen that details of demise of the wife of Applicant are appended at page Nos. 20-21 of the Application. I have perused the medical certificate as also the death certificate which are appended to the Application and the grounds stated in the Application. Considering the exigency mentioned by the Applicant, present Application deserves to be allowed. Needless to state that Applicant shall ensure strict adherence of the condition of not to influence any witness or tamper with the evidence in any manner for which he has been indicted during the period of relaxation granted by this order. 5.

In view of the above observations, Applicant is permitted to enter the jurisdiction of Mumbai Suburban District so that he can visit his residence in Vikhroli for the purpose of carrying out the rituals of his demised wife upto 17.03.2025 as requested by him and the condition No. (iii) is relaxed to that extent. 6.

Applicant is directed to register his attendance with DCB CID Unit - VII on all days i.e. from 12.03.2025 to 17.03.2025 which is the period during which he is permitted to enter the jurisdiction of Mumbai Suburban District. If there is any dereliction on the part of the

Applicant, it shall be open to the prosecution to bring it to the notice of the Court for cancellation of this order.

With the above directions, Interim Application is allowed and disposed.
