By the present Application, the Applicant has sought for the following relief :- "a.
This Hon'ble Court be pleased to relax and/or reduce and/or delete or modify the condition no. (iii) in the order dated 16th October 2024 passed by this Hon'ble Court in the aforesaid Criminal Bail Application No. 3895 of 2024, whereby released the Applicant on bail on such terms and conditions."

This matter was taken up on 10th July 2025 and the following
order was made :- "1.
Heard Mr. Aditya Raktade, learned Advocate for the Applicants and Ms. Madhavi Mhatre, learned A.P.P. for the State/Respondent.

Mr. Aditya Raktade, learned Advocate for the Applicants submits that by the present Application, a request is made for modification of condition no. 3 in the order dated 16th October 2024, passed by this Court in Criminal Bail Application No. 3895 of 2024. He submits that considering that the Applicants are the agriculturists and this is a season for agriculture, he prays that the request made in the present Application, be considered atleast in respect of one of the Applicants.

Ms. Madhavi Mhatre, learned A.P.P. for the State/Respondent submits that she would take instructions from the Investigating Officer with regards to the threat perception the witness may have, if condition no. 3 is relaxed. Hence, she prays for time. 4.
At the request of Ms. Madhavi Mhatre, learned A.P.P. and by consent of the parties, list the matter on 16th July 2025."

Mr. Aditya Raktade, learned Advocate for the Applicant submits that he has instructions from Nivrutti Rajaram Patil (Applicant No. 1) to withdraw the request for relaxation of condition on his behalf, hence he craves leave to delete the name of Applicant No. 1 from the cause-title of the present Application. Leave granted to delete the name of Nivrutti Rajaram Patil from the cause-title of the present Application. Amendment to be carried out forthwith.

This Application is restricted to the sole Applicant, i.e., Arun Rajaram Patil.

By order dated 16th October 2024 passed in Criminal Bail Application No. 3895 of 2024, this Court had granted bail to Nivrutti Rajaram Patil and Applicant on the conditions referred to in paragraph no. 4(i) to (vii) therein.

Applicant is seeking relaxation of the bail condition no. 4(iii) for the reasons stated in paragraph nos. 4(a) to 4(f) of the present Application. Mr. Aditya Raktade, learned Advocate for the Applicant submits that Applicant is an agriculturist and as such, intents to carry out farming activities during agriculture season, which would extent upto the month of November 2025. 8.
Ms. Madhavi Mhatre, learned A.P.P. for the State/Respondent on instructions from the Investigating Officer submits that at present there is no threat perception, if the Applicant enters the territorial jurisdiction of Chandgad Police Station for the purpose of carrying out agricultural activities in his fields. She submits that the Investigating Officer does not object for relaxation of bail condition no. 4(iii) with reference to Applicant (Arun Rajaram Patil) for a limited period, i.e., from 17th July 2025 upto 30th November 2025. She submits that the said relaxation be granted subject to the Applicant giving a further undertaking that he will not interfere with any of the prosecution witnesses. 9.
Mr. Aditya Raktade, learned Advocate on instructions from the Applicant submits that the Applicant undertakes not to interfere with the prosecution witnesses in any manner during the
period from 17th July 2025 to 30th November 2025. 10.
In view of the above and the statement made by Mr. Aditya Raktade, learned Advocate on instructions from the Applicant (Arun Rajaram Patil), bail condition no. 4(iii) of the order dated 16th October 2024 passed in Criminal Bail Application No. 3895 of 2024 is relaxed in the case of the Applicant for a period commencing from 17th July 2025 upto 30th November 2025. 11.
Mr. Aditya Raktade, learned Advocate submits that the Applicant (Arun Rajaram Patil) shall leave the territorial jurisdiction of Chandgad Police Station, District-Kolhapur, latest by 5.00 p.m. on 30th November 2025. Statement accepted. 12.
It is clarified that all other conditions of bail referred in the order dated 16th October 2024 passed in Criminal Bail Application No. 3895 of 2024 shall continue to operate.

All the bail conditions in the order dated 16th October 2024 passed in Criminal Bail Application No. 3895 of 2024 as far as Nivrutti Rajaram Patil shall continue.

In view of the above, Interim Application No. 1103 of 2025 stands disposed of in the aforesaid terms.
