By this Interim Application, the Applicant seeks modification/relaxation of the condition imposed by this Court vide order dated 15th January 2025. The condition of which modification/relaxation is sought reads thus: "(i) During pendency and final disposal of the present appeal, the Applicant-Willam Jacob Wargis is directed to be released on bail on executing Personal bond in the sum of Rs.30,000/- with one or two sureties in the like amount." 1/3

Learned counsel for the Applicant states that the said Interim Application seeking suspension of sentence and enlargement on bail was filed through the Legal Services Authority, as the Applicant was unable to engage a private Advocate due to paucity of funds. He states that despite the order dated 15th January 2025 enlarging the Applicant on bail pending the hearing and final disposal of his Appeal, the Applicant is still in custody, as he is unable to furnish surety, as directed by this Court vide order dated 15th January 2025. 3.
The same is not disputed by the learned APP.

We find that despite bail being granted to the Applicant in January 2025, he is still in custody as he is unable to furnish surety. Accordingly, we allow the Application on the following terms and conditions:
ORDER
(i) The Applicant shall now be enlarged on bail during pendency and final disposal of his Appeal on executing a personal bond in the sum of Rs.30,000/-.

(ii) The Applicant be released on cash bail of Rs.10,000/- for a period of 12 weeks from today.
(iii) Within the said period of 12 weeks, the Applicant shall furnish one surety in the sum of Rs.10,000/- to the satisfaction of the trial Court.

The Application is allowed and disposed off on the aforesaid terms.
