Applicant was released on bail pursuant to the order dated 24th September, 2024 passed in Criminal Bail Application No. 2653 of 2024. Amongst other conditions, the bail condition No. 7(iii) reads as under :
"iii) The applicant shall attend the said Police Station on 1st day of every month between 10.00a.m. to 11.00 a.m., till the conclusion of the trial except on the date of trial;"

By the present Application, the Applicant is seeking relaxation of the aforesaid bail condition No. 7(iii) on the ground that the Applicant is permanent resident of Agra, State of Uttar Pradesh and the said condition is causing inconvenience as well as financial hardship to the Applicant travel to Ghoti Police Station, Nashik every month, for marking attendance.
4. Mr. Akshay Bankapur states that the Crime No. 35 of 2024 is now registered as Sessions Case No. 152 of 2024 and trial in the said case has commenced before the Additional Sessions Judge, Nashik. He states that the Applicant is regularly appearing in Sessions Case No. 152 of 2024, as and when the date is fixed. 5.
Mr. Khan, learned APP on instructions from the Investigating Officer states that the prosecution has no objection to relax the condition No. 7(iii) in the bail order dated 24th September, 2024 on an undertaking of the Applicant that he shall regularly appear before the learned Sessions Court, Nashik in
Sessions Case No. 152 of 2024.

Mr. Akshay Bankapur, learned Advocate for the Applicant on instructions from the Applicant states that the Applicant shall appear on each and every date before the learned Court of Additional Sessions Judge, Nashik in Sessions Case No. 152 of 2024, unless exempted. The statement is accepted as a statement to the Court.

In view of the above and no objection given by the prosecution, bail condition No. 7(iii) of the order dated 24th September, 2024 passed in Criminal Bail Application No. 2653 of 2024 is relaxed. Rest of the conditions in the order dated 24th September, 2024 shall continue.

Interim Application No. 1146 of 2025 is disposed of in the above said terms.
