The original complainant has filed this application to withdraw the amount of Rs.1,50,000/- which the respondent / original accused has deposited.

The learned Counsel for the applicant submits that the __________________________________________________ 24 July 2025

Mamta Kale 913-ia-1161-2025 in aba2813-2024.docx original accused has deposited amount of Rs.1,50,000/- as agreed vide order dated 10 December 2024 in Anticipatory Bail Application No. 2813 of 2024.

The learned Counsel for the respondent / accused opposed applicant's withdrawal of the amount, on the apprehension that they might not deposit it back. However, the apprehension of respondent / original accused can be taken care of by directing the applicant to give an undertaking to deposit the same amount if the trial Court directs so after conclusion of the trial.

In view thereof, the applicant is permitted to withdraw the aforesaid amount of Rs.1,50,000/- from the Registry of this Court on the condition that she submits an undertaking that she will deposit the said amount if the trial Court after conclusion of the trial directs so.
