1) These are the Applications for condonation of delay and restoration of Criminal Writ Petition No. 1508 of 2010, which was dismissed for non-prosecution by Order dated 31st August, 2023. 1/3

KSG 14-IA-1193-2025.doc 1.1) There is delay of 524 days in preferring the present Application. 2) Mr. Halwasia, appearing for the Respondent No.7 vehemently opposed the Applications.

2.1) We are unable to accept the submissions of Mr.Halwasia, appearing for a Government entity. It is invariably observed by us that, in many matters the Government entities prefer Appeals, Petitions, with inordinate and/or colossal delay and this Court with magnanimity generally condones the same and therefore opposition by a Government entity for restoration of Petition filed by another Government entity, according to us is not proper.

3) Mr. Bhave, learned counsel appearing for the Applicants on instructions submitted that, for condonation of said inordinate delay the Applicants will pay a cost of Rs.20,000/- to the Bar Council of Maharashtra and Goa's Advocate Academy and Research Center within a period of two weeks from the date of uploading of the present Order on the official website of High Court of Bombay. The said statement is accepted as an undertaking given to this Court.
