Heard learned Counsel for the Applicant and learned APP for Respondent No.1 State.

This is an application for permission to withdraw Rs.5 lakh deposited in this Court in connection with FIR No. 113 of 2023. The Applicant is the first informant.

Perusal of the order dated 17.02.2025 (by which anticipatory bail was granted) indicates that there are disputed facts involved about the amount repaid by the accused. The order only records that the Sneha Chavan 1/2

77-IA-1222-2025 (CR).doc accused has deposited Rs.5 lakhs and the accused has no objection, if it is returned to the first informant.

The State has filed affidavit-in-reply through the officer of the concerned Police Station, indicating that there are other investors also involved. The order of this Court also records that Rs.10 lakh shall remain deposited with the Trial Court.

Considering the aforesaid facts and circumstances, it would be desirable to let the Trial Court decide upon the application of the first informant about withdrawal of money.

In that view of the matter, this application is disposed of with liberty to the Applicant to apply to the concerned Trial Court for seeking withdrawal of the amount, which would be decided in accordance with law.

The amount of Rs.5 lakh lying in this Court with accrued interest, if any, be transferred to the Special MPID Court, Mumbai (Sessions Court) in the account of concerned criminal proceeding. 8.
