The applicant's first bail application was disposed of as withdrawn with liberty to file a fresh application in the event the applicant's appeal was not heard within one year. The said order is at Exhibit - B on page 168 of the application.

From the said order passed by this Court, (Coram : A.S.Gadkari & Shyam C. Chandak, JJ) on 12th January, 2024, it appears that the said application was withdrawn when the Court was not inclined to grant bail to the applicant.

Considering the aforesaid, judicial propriety requires that the present application be placed before the same bench. 5.
