It is contention of learned counsel for the Applicant that Respondent No.2 had previously appeared but thereafter he did not appear before this Court and now he is not traceable. 7.

Considering the submission of both learned counsel, the application is allowed in terms of prayer clause (a). 8.

The Applicant shall publish the notice in local newspaper in the Thane area, one in Marathi and other in English newspaper. 9.
