Mr. Pyarelal informs the Court that efforts are made by his client - Developer to ensure that all conditions which have been agreed upon as conditions for grant of anticipatory bail are complied with. In the first instance he would inform the Court that pursuant to the previous order passed by this Court possession of the flat has been handed over to the private Respondents and registration is also effected. He would submit that there are certain issues, inter alia, pertaining to fixation of electricity meter, the deposits concerned there with but the developer shall sort out same. With regard to water connection he would submit that developer is in talks with the Society for compliance of the outstanding arrear amount as there is a dispute with respect to the same and negotiations are going on.

Be that as it may, it is the responsibility and liability of the developer to ensure that the said outstandings are cleared. Mr. Pyarelal would inform the Court that he shall persuade his client to ensure that positive steps are taken by him and he shall accordingly apprise the Court about further development on the next adjourned date.

This Court makes it clear that Application shall be kept on regular basis to ensure that compliance is effected and if not Court shall be constrained to hear the Application and decide the same in accordance with law.

Ad-interim / interim relief to continue only upto the next date of hearing.

Stand over to 1st August, 2025 for hearing.
