Heard Mr. Gaurav Parkar, learned Advocate for the Applicant and Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent.

By order dated 20th December 2024, passed in Criminal Bail Application No. 2513 of 2024, the Applicant was released on bail on the bail conditions at Paragraph Nos. 6(i) to (vi). 3.

By the present Application, the Applicant has sought for the following relief :- "a) That this Hon'ble Court be pleased to modify Condition No. (iii) of the order dated 20th December 2024."

Bail Condition No. 6(iii) of the order dated 20th December 2024 reads as follows :- "(iii) The Applicant shall attend Kalamboli Police Station, Navi Mumbai, on every 1st and 16th of every month between 10.00 a.m. and 11.00 p.m. till conclusion of trial."

Mr. Gaurav Parkar, learned Advocate for the Applicant states that the Charge is framed and the proceedings are now registered as 'R.C.C. No. 158 of 2024'. He states that the Applicant is regularly appearing in the said case before the learned Judicial Magistrate First Class, Panvel. He submits that the learned Court having taken cognizance and the Applicant having submitted to the jurisdiction of the Court, Condition No. 6(iii) of the order dated 20th December 2024, which requires the Applicant to attend the Police Station, is causing inconvenience to the Applicant. He states that he has instructions from the Applicant to make a statement that the Applicant shall appear before the learned Court on each and every date fixed by the learned Judicial Magistrate First Class in R.C.C. No. 158 of 2024.

Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent submits that the charge-sheet is filed, the case is registered as 'R.C.C. No. 158 of 2024' and the Applicant is appearing before the learned Court. He further submits that in the event, the Applicant undertakes to appear on each dates of hearing before the Court in R.C.C. No. 158 of 2024, then the Application of the Applicant can be considered.

Mr. Gaurav Parkar, learned Advocate reiterates that he has been instructed by the Applicant to state that the Applicant shall appear before the learned Judicial Magistrate First Class at Panvel on each date of hearing. The said statement is accepted. 8.

In view of the above and considering the statement made by the Applicant, Bail Condition No. 6(iii) of the order dated 20th December 2024, passed in Criminal Bail Application No. 2513 of 2024, is relaxed. All other conditions of the order dated 20th December 2024 continue.

Interim Application No. 1329 of 2025 stands disposed of in the abovesaid terms.
