By way of this application, the Applicant seeks relaxation of Condition (b) in the Bail Order dated 14th June 2024, passed by this Court in Criminal Bail Application No. 1857 of 2022. The Condition (b) which is sought to be relaxed requires the Applicant to report to the DCP, CID, Unit V, Kurla, on every 2nd and 4th Monday of each month between

10:00 a.m. and 12:00 noon, during to the pendency of the trial.

Heard learned Counsel for the respective parties. 3.

Ms. Mayanka, learned Counsel for the Applicant, submits that the trial has commenced and one witness has already examined. She further submits that the Applicants are regularly attending the Sessions Court approximately once in 15 days, and that one co-accused remains in custody. She states that the Applicants are poor laborers earning daily wages at a construction site, and missing a single day results in loss of wages for that day. She also submits that the Applicants have not violated or misused the liberty and are regularly attending the concerned police station as directed and have attended for above 20 times so far. Mr. Yogesh Dabke, learned APP, fairly concedes that since the trial has commenced, there is no requirement for the Applicants to visit the police station as directed in Condition (b) to the bail order.

In view of the aforesaid, Condition (b) of the bail order dated 14th June 2024 is deleted. Rest of the conditions remain as it is.

The application is disposed of accordingly.
