Ms. Gauri Rao, learned APP representing the State in the matter, on instructions, states that charges are not framed as yet.

The condition imposed on the Applicant by order dated 13th March 2024 is, not to enter limits of Nizampura Police

Shivgan 73-IA-1365-2025.doc Station for a period of 3 years or till the conclusion of the trial, whichever is earlier. It is almost 1 year and 11 months since the Applicant is put out of the jurisdiction of the said Police Station and consequently, his home.

Ms. Gauri Rao, learned APP representing the State in the matter, on instructions, states that the charges are likely to be framed very soon.

In view of the statement made by Ms. Rao, learned APP, Ms. Tahera Qureshi, learned counsel appearing for the Applicant, seeks permission to withdraw the present Interim Application with liberty to file a fresh Interim Application seeking modification of condition after 6 months from today, if there is no substantial progress in the trial within the said period.

Permission to withdraw is granted with the aforesaid liberty.
