By this application the applicant is seeking return of the passport deposited before the Registry of City Civil and Sessions Court, Mumbai. 2.

Learned counsel for the applicant submitted that applicant wants to attend the religious program in Iraq and intends to travel from 15.04.2025 to 16.05.2025. Earlier applicant was permitted to go abroad. The applicant undertakes to redeposit the passport with Registry of City Civil and Sessions Court, Mumbai and requested to allow the application. 3.

Learned APP strongly objected to allow the application on the ground that applicant is NRI. If application is allowed, he may abscond and requested to reject the application.

I have heard both the learned counsel. The applicant intends the attend the religious program in Iraq and intends to travel from 15.04.2025 to 16.05.2025. He undertakes that after returning from Iraq, he will deposit the passport with Registry of City Civil and Sessions Court, Mumbai. Considering these facts, I pass following order.

ORDER

(i) The application is allowed.

(ii) The Registry of City Civil and Sessions Court, Mumbai is directed to return the passport to the applicant. (iii) The applicant shall file undertaking before the Registrar City Civil and Sessions Court that he will deposit the passport after returning from Iraq. 5.

Interim Application is disposed of.
