Learned Counsel for the Applicant/Appellant submits that in view of the ground that there is sentence recorded against the deceased of fine, the Applicant being a legal representative of the deceased would wish to continue with the appeal. Considering the impugned Judgment and Order, there is substance in the said contention. Hence, application stands allowed in terms of prayer clause (a).
