Present Interim Application is filed for condonation of 21 days' delay caused in filing Criminal Application for leave to Appeal against the judgment and order of acquittal dated 17.10.2024 passed by the learned Sessions Judge,Thane in Sessions Case No.231/2020. The Respondent is served and is represented by a Counsel.

Learned APP appearing for the Applicant states that the impugned judgment and order was passed on 17.10.2024 and the application for certified copies were preferred on 19.10.2024. The same were ready on 16.12.2024 and delivered on 17.12.2024. The papers were sent by the concerned Assistant Public Prosecutor, Thane to the Law and Judiciary Department requesting to prefer an application for leave to file Appeal. The Law and Judiciary Department after receiving and scrutinizing the papers, granted approval. The papers were forwarded to the office of the learned APP on 17.3.2025. Thereafter the Application was drafted and was filed on 4.4.2025. She states that the delay of 21 days is not intentional or deliberate but for the reasons mentioned above. 3.
Learned counsel for the Respondent opposes the present application.

Having heard the learned counsel for the parties, we are satisfied that the delay which is caused in preferring the present Interim Application is not intentional but for the reasons mentions more specifically in paragraph No.2 of the

present Interim Application, we are satisfied that this is a fit case for condonation of delay. Hence, the following order : :: O R D E R ::
i.
The delay of 21 days caused in filing the Criminal Application for leave to Appeal, is condoned. ii.
Interim Application No.1475/2025 is disposed of accordingly.
