DATE : 22nd JANUARY, 2026.
P.C. :
1.
By this application, the applicant is seeking relaxation of bail condition imposed by this Court (Coram: N.R.Borkar, J.) dated 30.01.2025. 2.
Learned counsel for the applicant submits that by order dated 30.01.2025, this Court in paragraph No. 7(B), has imposed condition "The Applicant shall not enter into the limits of Pune District except to attend the dates before the trial Court till conclusion of the trial." 3.
It is contention of learned counsel for the applicant that applicant is a lawyer by profession. He is out of Pune District for one year. His family is suffering and requested to relax the said condition. 4.
Learned APP strongly objected to allow the application on the
95-IA-1626-2025 (CR).doc S.S.Kilaje ground that applicant was in constant contact with the co-accused who has been charged under Section 302 and relevant Sections of Indian Penal Code, 1860. Hence, the applicant cannot seek cancellation of the condition. 5.
I have heard both the learned counsel. The applicant is lawyer by profession. He is out of Pune District for one year. There is no progress in the trial. Considering this fact, I pass following order.
ORDER
(a) Condition No. 7 (B) of the Order dated 30.01.2025 is hereby relaxed as :
"The Applicant shall attend the police Station as and when required."
6.
Interim Application is disposed of.
