Learned counsel for the applicant submits that original accusedapplicant in A.B.A. 798 of 2023 has deposited Rs.75 lakhs while hearing Anticipatory Bail Application. The allegations against the original accused are that he has cheated the applicant hence applicant be permitted to withdraw the amount deposited by original accused. 3.

Learned counsel for original accused, on instructions submits that original accused has no objection for withdrawal of amount. 1/2

Considering the submission of both the learned counsel, I pass following order:

ORDER

i.

The Interim Application is allowed.

ii.

The applicant is permitted to withdraw the amount of Rs.75 lakhs deposited by original accused with undertaking that if required as and when, he will redeposit the said amount. 5.

Interim Application is disposed of.
