This is an Application for condonation of delay of 33 days in filing the Appeal against the judgment and order dated 12/12/2024 passed in Sessions Case No.241 of 2019 by the Additional Sessions Judge, Thane. The Applicant was convicted for commission of offence under Section 302 and 341 of the Indian Penal Code as well as under Section 4 and 25 of the Indian Arms Act. The major punishment imposed on him was for life imprisonment.

Learned Counsel for the Applicant submitted that the Applicant is not in sound financial condition. Therefore, the Appeal has to be prepared H. C. Shiv 1/2

11.ia1634.25.doc with the help of the Legal Services Authority of this Court. Some time was lost in collecting the papers and preparing the Appeal. Therefore, there is a delay of 33 days in filing the Appeal.

Learned APP has not serious objection to condone the delay in filing the aforesaid Appeal.

Considering these submissions and in the interest of justice, we are inclined to allow this Application. Hence, the order : :: ORDER ::

i. The Application is allowed.

ii. The delay of 33 days in preferring the Appeal is condoned. The Appeal be processed further.
