There was a Complaint for the offence under Section 138 of the Negotiable Instruments Act, 1881 before the Court of Metropolitan Magistrate, 63rd Court. The case was fixed for recording of evidence. The Complainant could not remain present and that is why, it got dismissed.

The Applicant intends to file an Appeal. Leave Application was filed. However, the company went into liquidation. The permission is sought from the National Company Law Tribunal to file proceeding. Hard copy of the order dated 26th February 2025 is tendered. It is taken on record and marked as Annexure-X. The Resolution Professional is granted permission.

There is a delay in preferring the Appeal. The leave is also sought. That is why, there are two Interim Applications. 5.
Issue notice on both the Applications returnable on 14th July 2025. Private notice, in addition, is allowed. Affidavit of service be filed. Learned APP waives notice for Respondent No.3-State. 6.
The narrow issue is involved. The Court should make an endeavour to decide it finally.
