This is an application seeking relaxation of the condition (d) imposed on the Applicant by order dated 6th January 2023 passed by this Court. The said condition reads as thus;

"(d) The applicant shall report to the Investigating Officer on the first and third Monday of every month, between 11.00a.m. and 1.00 p.m."

Mr. Zafar Gujar, learned counsel appearing for the Applicant, submits that the Applicant is resident of Mumbai and is complying with the said condition regularly. However, now the Applicant is undergoing some training in Delhi as he is preparing for a competitive examination. In these circumstances, it is highly difficult for him to travel to Mumbai on the 1st and 3rd Monday of every month, in compliance of the condition (d) of the said order. He thus, seeks relaxation of the said condition.

Per contra, Mr. Yogesh Dabke, learned APP representing the State in the matter, submits that instead of relaxing the entire condition altogether, it will meet the ends of justice if the Applicant is directed to report to the Investigating Officer concerned once in two months.

I have heard the counsel appearing for the respective parties.

Admittedly, the order granting bail to the Applicant is dated 6th January 2023 and the Applicant is complying with the said condition regularly, till date. Even the charges are not framed, as on date. In the circumstances that the Applicant is undergoing training in Delhi and preparing for a competitive examination, I am of the opinion that it will sub-serve the ends of justice if the said condition is relaxed to the extent that the Applicant shall report to the Investigating Officer concerned on the first Saturday, once in two months, at any time during that day. Accordingly, the said condition is relaxed to the limited extent.

Rest of the order remains as it is.

Interim Application is partly allowed and is disposed accordingly.
