ASHWINI H GAJAKOSH P.C.:- ASHWINI H GAJAKOSH Date: 2025.05.14 20:40:48 +0530 1) Mr. Halwasia, learned Advocate for Respondent Nos.2 has fairly submitted that, Respondent No.2 has no objection if the Interim Application filed by the Applicant is allowed.
2) In view of the above statement by Respondent No.2, the Application is allowed in terms of prayer clause (a), which is reproduced hereinbelow for ready reference:
"(a) Permit the Applicant to travel abroad i.e. from Mumbai to Moscow via Abu Dhabi from 13/05/2025 to 31/05/2025 and from Mumbai to New York for the period 1/3
14/06/2025 to 28/06/2025 for business purpose upon such a terms and conditions as the Hon'ble Court may deem, fit and proper."
3) Learned Advocate for the Applicant submitted that, the Applicant's travel plans are stated in paragraphs 5 and 7 to the Application. Accordingly, Application is allowed subject to the conditions listed hereinbelow:
(i) The Applicant - Ramesh Himatlal Shah is permitted to travel overseas from Mumbai to Moscow via Abu Dhabi from 13th May, 2025 to 31st May, 2025 and from Mumbai to New York from 14th June, 2025 to 28th June, 2025, the LOC issued as against the Applicant at the behest of the Respondent No.2SFIO shall stand suspended. (ii) Forty Eight (48) hours prior to his departure, the Applicant,, shall furnish the full itinerary of his overseas travel with all details, including the address/addresses where he would stay, his telephone/mobile/contact numbers, on which he can be contacted during the said period, to the Respondent No.2SFIO, via e-mail/fax or any other electronic mode; (iii) The Respondent No.2-SFIO shall inform the Immigration Authorities of the Order passed today, at the earliest and in any event, within 48 hours of the Order being uploaded on the 2/3
official website of the High Court of Bombay; (iv) The Applicant shall also inform of his return to the SFIO within 72 hours of his return;
(v) The Immigration Authorities, on all points of departure, shall permit the Applicant to pass through immigration and to board his flight or flights, irrespective of whether the immigration system has been updated and whether the SFIO has informed the Immigration Authorities or not.
4) It is further clarified that this Order does not apply to any other Look Out Circular and/or restraint Order, if issued by any other Authority/Court/Agency/Bank. The invalidation of the present LOC will not affect the other restraint Orders.
