CRIMINAL APPELLATE JURISDICTION CRI-INTERIM APPLICATION NO. 1883 OF 2025 IN CRIMINAL BAIL APPLICATION. NO. 4908 OF 2024 Sandeep Vitthal Chikane ...Applicant

Versus

The State Of Maharashtra

...Respondent

__________ Mr. Anvay Pawar a/w Pramod J. Pawar, for the Applicant. Mr. S.H. Yadav, APP for the respondent-State. __________ CORAM :

ADVAIT M. SETHNA, J.

DATE :

13 MAY 2025 (VACATION COURT) P.C.:

1.

Not on board. Upon mentioning taken on board. 2.

This is an Interim Application filed for the purpose of limited relief to alter/modify the bail condition "C" imposed by the order dated 18 March 2025 of this Court, which reads thus:- "C] The applicant shall not enter into the limits of Taluka Purandar, till conclusion of trial"

3.

The learned Advocate for the applicant is seeking relaxation of the condition as above, primarily on the ground that his father, who was in serious/critical medical condition admitted in ICU at Bhartiya Vidyapith Hospital, Pune is unfortunately no more. He passed away on 12 May 2025

at the said hospital in Pune. It is in light of such subsequent developments that the applicant would have to travel and would inevitably enter within the limits of Taluka Purandar for the purpose of performing the last rites of his father.

4.

The learned APP would fairly not oppose the application. He would not dispute the fact that the father of the applicant has passed away on 12 May 2025 for which the son i.e, the applicant would be required to perform the last rites. Considering such fact, he would submit that the condition "C" of the order dated 18 March 2025 be suitably modified. 5.

Having heard the learned counsel for the parties and considering the aforesaid facts and circumstances, the following order would serve the interest of justice :-

ORDER

(i) The condition "C" in the order dated 18 March 2025 is modified and shall read thus: - C] The applicant is permitted to enter the limits of Taluka Purandar for a period of two weeks from today. Thereafter, the condition as imposed in the order dated 18 March 2025 shall revive and continue to operate till the conclusion of the trial as directed in the order of this Court dated 18 March 2025. (ii) The modified condition to read accordingly. (iii) The learned APP shall circulate a copy of this order to the

Senior Police Inspector of the concerned Police Station. A copy of this order shall also be served to the Advocate for the complainant.

6.

In view of the above the interim application stands disposed of. [ADVAIT M. SETHNA, J.]
