P.C.:- 1) This is an Application for modification of condition of bail imposed upon the Applicant vide Judgment and Order dated 20th September, 2024, passed by this Court in Criminal Appeal No.491 of 2024. The condition No. 26(vi) reads as under:- (vi) The appellant shall not leave the jurisdiction of NIA Court, Greater Bombay, till the conclusion of the trial, without the prior permission of the NIA Court." 2) Mr. Solkar, learned counsel for the Applicant submitted that, since the date of release from jail, the Applicant is scrupulously following the said condition and while leaving the jurisdiction of NIA Court, Greater 1/2
ssm 2 20-ia1906.2025.doc Mumbai, he had sought permissions which were accordingly granted by the concerned Court.
2.1) He submitted that, the Applicant is ordinary resident of Pune city. His family with his children are residing at Pune and it is very difficult for the Applicant to visit his family members regularly. Mr. Solkar therefore requested this Court to suitably modify the said condition to enable the Applicant to reside with his family members. He on instructions submitted that, the Applicant is otherwise also attending the trial Court at Mumbai three times a week and is co-operating with the NIA Court in conducting trial of the said case.
3) Upon a query of this Court, Mr. Patil learned APP on instructions submitted that, there is a NIA Special Court established at Pune.
4) In view of the above, condition No. 26(vi) of Judgment and Order dated 20th September, 2024 is accordingly modified and substituted by the following condition4.1) The Applicant is directed not to leave the jurisdiction of NIA Court, Greater Mumbai and NIA Court, Pune District till the conclusion of present trial, without the prior permission of NIA Court, Mumbai. 5) Application is allowed in the aforesaid terms.
