This application is filed by accused no.2 for relaxing condition no.III imposed while granting bail by this Court vide order dated 7th January 2023. Learned counsel for the applicant submits that the applicant was arrested on 17th February 2022. The chargesheet is filed on 13th April 2022 in the Court of 1/3

Sessions At Thane. She further submits that on 31st October 2023, the case is transferred to Bhivandi Sessions Court and is still pending at the stage of framing charge. She submits that the applicant has given birth to a female child on 21st February 2025 and is currently undergoing postnatal recovery. She therefore submits that the condition no.III directing the applicant to appear before the Investigating Officer once in a month be relaxed. 2.

Learned APP submits that if the condition is to be relaxed, the applicant be directed that she shall appear before the Investigating Officer as and when called and shall regularly attend all the dates in the trial Court.

Since the case is pending at the stage of framing charge, the condition no.III can be relaxed by modifying the condition as follows.

i) The condition no.III in order dated 7th January 2023 in Bail Application No.1934 of 2022 is modified by directing the applicant to appear before the Investigating Officer as and when called. The applicant shall attend every date before the trial Court unless specifically exempted by an order in writing by the Court.

It is clarified that the remaining conditions in order dated 7th January 2023 shall operate and shall be binding on the applicant. 5.
