This Interim Application has been filed under Section 5 of the Limitation Act, 1963 with a prayer to condone the delay of 87 days in filing the connected Appeal.

We have perused the explanation furnished for the delay. After assessing the explanation of delay furnished by the Applicant and taking note of the fact that the Applicant has a statutory right to prefer an Appeal against the Judgment and Order of conviction, we find that it is a fit case where the delay deserves to be condoned.
