Heard Mr. Promod Arjunwadkar, learned Advocate for the Applicant and Mr. Sameer Mangaonkar, learned APP for RespondentState. 2.

By the present Application, the Appellant/Applicant who is convicted for the offence under sections 7 and 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988 seeks suspension of the sentence and release of the Applicant on bail. Substantive sentence of imprisonment awarded in Special Case No. 1 of 2017 is of one year in

respect of offence punishable under sections 7 and one year in respect of offence punishable under section 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988. The substantive sentences of imprisonment are ordered to run concurrently. 3.

The learned Advocate for the Applicant states that during the pendency of the Special Case No. 1 of 2017 before the learned Special Judge, the Applicant was on bail. He states that he has abided by the conditions of bail, as were imposed in the said Special Case No. 1 of 2017. The learned APP acknowledges the said fact. 4.

The Appeal filed by the Appellant is admitted. 5.

In view of the above, present Application is granted on the following terms:

(a) The sentence imposed in Special Case No. 1 of 2017 shall stand suspended pending hearing and final disposal of the Criminal Appeal No. 561 of 2025.

(b) Applicant shall be released on furnishing P.R. Bond in the sum of Rs. 50,000/- with one or two sureties in the like amount to the satisfaction of learned Special Judge, (The Prevention of Corruption Act, 1988) Thane (Additional Sessions Judge-1 Thane). (c) The Appellant/Applicant shall appear before this Court as and when Criminal Appeal No. 561 2025 is listed for hearing. (d) The Appellant/Applicant shall furnish his residential address and

his mobile number to the Investigating Officer, Thane Nagar Police Station, Thane.

The Interim Application is allowed and disposed of in the above terms.
