Heard learned Advocate Shri.Vagal for the Appellant and the learned APP.

The Appellant is convicted for the offence under Section 8 of the Prevention of Corruption Act, 1988 on the allegation that he induced 1/3

the de-facto Complainant to part away illegal gratification for arranging the experience certificate. The wireman license is to be obtained from Vidyut Karyalaya, Udhyog ani Urja, Kamgar Vibhag, Chembur, Mumbai. The sentence is as follows:- (a) Rigorous imprisonment for 3 years and fine of Rs.50,000/- (Rupees Fifty Thousand).

There are no instructions about the payment of fine. 3.

The contention is, from the investigation and the evidence, it is not clear the illegal gratification was accepted on whose behalf from that department.

Admit the Appeal.

Call Record and Proceeding.

The trial Court has suspended the sentence after conviction on 29th April 2025. The Applicant is a permanent resident of Mumbai and he assures to co-operate for hearing of the Appeal. Hence, the following order:-

O R D E R

(i) The substantive sentence is suspended during pendency of the Appeal subject to following conditions:- (a) The Appellant to furnish PB and SB of Rs.20,000/- (Rupees Twenty Thousand) before the trial Court within a period of 4 weeks from today.

(b) To deposit the amount of fine before the trial Court within 4 weeks prior to furnishing bail.

(c) To co-operate the hearing of the Appeal.

(d) To produce the copy of fine receipt on the next date. 7.
