1) This is an Application for suspension of sentence and releasing the Applicant on bail during the pendency of Appeal. 2) It is the prosecution case that, the Applicant booked a tourist vehicle from Ola company on 21st June 2019 for going to his desired place. Mr. Sunil Shastri (deceased) was the driver of the said vehicle. That, the Applicant thereafter committed murder of Sunil Shastri and decamped with his vehicle and mobile phone. After receipt of information, the police sent necessary messages to all the concerned Police Stations. The vehicle in question was spotted at Amirgad Check Post, State of Rajasthan. The 1/2
DTG 14-Ia-2035-2025.doc Applicant was driving the said vehicle at that relevant time. The Applicant was accosted by the Rajasthan police and the necessary information was given to the local Police Station. There is no satisfactory explanation offered by the Applicant about having the said stolen vehicle in his possession at Rajasthan. Prima facie it appears that, the chain of circumstances propounded by the prosecution is complete, indicating that the Applicant is the author of the present crime.
3) In view of the above, we are not inclined to grant bail to the Applicant during the pendency of Appeal.
Application is accordingly dismissed.
