DATED : 08th JULY, 2025 P.C. :- 1) This is an Application filed by the Original Appellant No.2 in the Criminal Appeal No.639 of 2022. He was the Original Accused No.3 in Sessions Case No.322 of 2018 before the learned Additional Sessions Judge, Nashik. The Original Accused Nos.2 and 3 were convicted. They have preferred this Criminal Appeal No.639 of 2022. It was already admitted. Now, the present Applicant i.e. Original Appellant No.2 wishes to pursue his own Appeal separately.
2) Learned Counsel for the Applicant submitted that he had already obtained NOC from the earlier Advocate who has filed a common Appeal. He seeks permission to pursue his own Appeal separately by filing a separate Appeal Memo.

Manoj 901-IA-2118-2025.doc 3) In the interest of justice, the Application is allowed. 4) The Applicant is permitted to pursue his separate Appeal. He shall file a separate Appeal Memo and also a note of appearance of the Advocate on record.
5) Filing of the certified copy is also dispensed with because it is already filed in the original Appeal.
6) The permission is granted to the learned Counsel for the Applicant to get the proposed Appeal circulated once it is filed, for directions.
