By this application, the applicant is seeking condonation of delay in filing the application to bring the legal heirs of appellant on record. It is the contention of learned counsel for applicant that original appellant was convicted under The Prevention of Corruption Act, 1988. He has preferred the 1/3

appeal. During the pendency of appeal, appellant is expired. Applicant is wife of deceased. Hence, her name to be taken on record to continue the appeal. There is delay of 4 years and 127 days in filing the application. Hence, requested to allow the application.

Learned APP strongly objected to allow the application. 3.

Considering the submissions of both the learned counsel in the application, application is allowed in in terms of prayer clauses (B) and (C). Delay of 4 years and 127 days in filing the application is condoned.

By this application, the applicant is praying leave to continue the appeal.
