Heard learned Advocate for the Appellant and learned APP. 2.

The Appellant is convicted for the offence punishable under Section 304(II) of the Indian Penal Code, 1860 ("IPC") and under Sections 184, 185, 134 read with 177 of the Motor Vehicles Act, 1988 ("MV Act"). The maximum sentence is 3 years. The amount of fine is deposited. There is endorsement on the copy of judgment itself. 3.

According to the Appellant, in fact this was pure accident. Whereas, according to the learned APP, the Appellant was driving the container under the influence of liquor.

Admit the Appeal.

Call the Record and Proceeding.

The trial Court has suspended the sentence. The Appellant assures to cooperate the hearing of the Appeal. His residential address is at District Hingoli. Whereas, the accident took place in the jurisdiction of Pangari Police Station, Taluka : Barshi. The presence of the Appellant needs to be secured at the time of hearing of the Appeal. Being a driver, he is required to go to various places along with his vehicle. So he can be asked to furnish a bail along with the surety who is a resident of Hingoli District. It is submitted, at present he is residing at Aurangabad. Let him give those details also. Hence the order:-

O R D E R

(i) The substantive sentence is suspended on furnishing personal bond and surety bond of Rs.20,000/- (Rupees Twenty Thousand).

(ii) Bail be furnished before the trial Court within 4 weeks from today.

(iii) The surety who is a resident of Hingoli District be furnished. (iv) He is directed to give the details of his residence at Aurangabad and also to inform the Court about change in the residence. The necessary amendment be made in the title clause earlier to the next date.

(v) The Appellant is directed to give attendance to the Pangari Police Station, Taluka : Barshi on first Monday from 10.00 to 12.00 noon of the month of August, December and February.

(vi) He is further directed to give details of his Aadhar Card and the Driving License to the Investigating Officer and to the Court before whom the surety is furnished.
