Heard Mr. Patel, learned Counsel appearing for the Applicant, Ms. Newton, learned APP for the Respondent-State of Maharashtra and Mr. Dodya, learned Counsel appearing for the First Informant. 2.
The Applicant by the present Interim Application is seeking relaxation of Condition No.7(iii) imposed by a learned Single Judge [Coram: N. R. Borkar, J.] by Order dated 13th January 2025 passed in Anticipatory Bail Application No.1392 of 2024. The said Condition No.7(iii) reads as under :-
"(iii) The applicant shall not enter into the limits of Village Sangavade, Taluka Maval, Dist. Pune till the conclusion of trial."

It is the submission of Mr. Patel, learned Counsel for the Applicant, that the Applicant's wife is eight months pregnant. He submits that the Applicant will abide by any other conditions imposed by this Court.

On the other hand, Ms. Newton, learned APP and Mr. Dodya, learned Counsel for the First Informant, strongly oppose the Interim Application. Both of them state that the incident in question has taken place within the Court premises and, therefore, the condition was rightly imposed.

However, in view of the fact that the Applicant's wife is pregnant, the above condition No.(iii) can be relaxed by imposing certain additional conditions.

Accordingly, instead of Clause No.7(iii), the following conditions are imposed :- i.
The Applicant will report to the Hinjawadi Police Station, Pimpri-Chinchwad, once in a week i.e. on every Sunday between 11:00 am to 01:00 pm.
ii.
Although the Applicant can enter into the limits of Village
Sangavade, Taluka Maval, District Pune, he shall not enter Gat No.314, Sangavade, Darumbre Road, Taluka Maval, District Pune.

The Interim Application is disposed of in above terms with no order as to costs.
