Heard learned Advocate for the Appellant - convicted Accused No.1 and learned APP.

He is convicted for the offences under Sections 307 and 326 read with Section 34 of the Indian Penal Code, 1860 along with the co-accused No.2 - Vitthal Mane. He is not before the Court. The 1/3
sentence is as follows:- (a) For the offence punishable under Section 307, rigorous imprisonment for 3 years and fine of Rs.2,000/- (Rupees Two Thousand). It is already paid.
(b) For the offence under Section 326, the sentence is rigorous imprisonment for 3 years and fine of Rs.2,000/- (Rupees Two Thousand). It is already paid.

The contention is, the Accused Nos.3 and 4 who have also beaten the other witnesses with wooden stick, they have been given a benefit of doubt. Whereas, the present Appellant No.1 is held guilty for assaulting the PW No.2 with wooden stick. 4.
Admit the Appeal.

Learned APP waives notice for Respondent - State. 7.
The trial Court has suspended the sentence. The Accused is permanent resident of Bhoitevasti, Khunte, Taluka : Phaltan, District : Satara. He assures to co-operate the hearing of the Appeal. Hence, following order:-
O R D E R
(i) The substantive sentence is suspended during pendency of the Appeal subject to following conditions:- (a) The Appellant to furnish PB and SB of Rs.15,000/- 2/3
(Rupees Fifteen Thousand) before the trial Court within a period of 4 weeks from today.
(b) He is directed to give attendance to Phaltan Gramin Police Station on every second Monday of the month of July and November from 10.00 to 12.00 noon for a period of 2 years.
