Versus

The State of Maharashtra and anr.

...Respondents

Ms. Anjali Patil, for the Applicant.

Ms. Priyanka S. Rane, APP, for Respondent No.1-State. Mr. Aamir Malik, for Respondent No.2.

CORAM:

SUMAN SHYAM & SHYAM C. CHANDAK, JJ.

DATED:

12th AUGUST, 2025.

PC:- 1.

This Interim Application has been filed with the twin prayers for suspension of jail sentence of the Applicant and also for early hearing and disposal of the criminal appeal. However, the first prayer in the Interim Application i.e. for suspension of jail sentence and for release of the accused on bail appears to be in clear contravention with the order dated 11th June, 2025 passed by this Court in an earlier application filed on behalf of the same Applicant.

20 IA 2250-25 IN APEAL 1494-19-CR.DOC 2.

By the order dated 11th June, 2025, the Applicant was granted leave only to file an application for early hearing of the appeal. However, within a week from the order dated 11th June, 2025, the present application has been filed with the aforementioned prayers.

3.

Since, the application is not as per the leave granted by this Court, we are not inclined to grant the prayer for suspension of sentence.

4.

In order to appreciate the prayer for early hearing of the appeal, a report be called for from the Jail Superintendent, to be submitted through the learned APP, within three weeks, indicating the total custody period of the Applicant and the remission period, if any, that he is entitled to under the law. 5.

The matter be listed again on 26th August, 2025. (SHYAM C. CHANDAK, J.) (SUMAN SHYAM, J.) { 12th August, 2025.
