By this Interim Application, the applicant has prayed for modification of Condition No.3 of the bail order dated 16th April 2024.

The reason stated by the applicant for seeking modification is that he is a permanent resident of Kolhapur, and therefore, it is causing inconvenience for him to report at the Chembur Police Station on the first Monday of every month, as directed by Condition No.3 of the said order.

However, it is important to note that the said reason was already known to the applicant on the date the bail order was
31-ia2289-2025 in ba1079-2024.doc passed. Despite being aware of his residence in Kolhapur, the applicant had not objected to the said condition at the time when the bail was granted. If the applicant was genuinely aggrieved by such a reporting condition, the proper legal course available to him was to challenge the same before a superior Court in accordance with law. Seeking modification of the order now, on a ground which was available earlier but not urged, does not amount to a bona fide or sufficient ground for modification. 4.
The conditions imposed while granting bail are not to be lightly interfered with unless it is shown that continuing with such condition would result in manifest hardship or it was imposed without application of mind. In the present case, no such exceptional circumstance has been made out.

In view of the aforesaid reasons, no case is made out for exercise of discretion for modifying the bail condition. 6.
Hence, the interim application stands rejected. (AMIT BORKAR, J.)
