Heard learned Advocate Shri.Shetty for the Appellant and learned APP.

He is convicted by the Additional Sessions Judge - Belapur for the offences punishable under Sections 353, 332 of IPC and under Section 129 read with 177 and 181 of the Motor Vehicles Act, 1988. The sentence is rigorous imprisonment for 2 years and fine of Rs.3,000/- (Rupees Three Thousand). There are different sentences. Total amount of fine comes to Rs.8,750/- (Rupees Eight Thousand Satish Sangar 1/2

During that incident, the shirt button of PW No.1 were removed. The contention is, the shirt is not seized. Even though C.C.T.V. footage is collected, the submission is, it does not support the prosecution case and the certificate is not proper. 4.

Admit the Appeal.

The substantive sentence is suspended by the trial Court. The Appellant is a permanent resident of Mumbai and now is married. He undertakes to cooperate the hearing of the Appeal. Hence, the following order:-

O R D E R

(i) The substantive sentence is suspended during pendency of the Appeal subject to furnishing personal bond and surety bond of Rs.15,000/- (Rupees Fifteen Thousand). (ii) Bail be furnished before the trial Court within 4 weeks from today.

(iii) The personal bond and surety bond if already given before the trial Court, be continued.
