This application has been filed under Section 5 of the Limitation Act, 1963 with a prayer to condone the delay of 3329 days in filing the connected appeal against the Judgment and Order dated 10th March, 2016 passed by the learned Sessions Judge, Khed.

The learned counsel for the Applicant submits that the Applicant has a good case on merits. That apart, since last 12 years and 4 months he has been in jail. As such, there was no proper opportunity for him to prefer the appeal.

In view of the submissions made at the Bar and considering the fact that the Applicant has a statutory right to prefer an appeal against a Judgment and Order of conviction, we are of the view that the relief in terms of clause (a) in the prayer be granted. Delay of 3329 days for filing appeal is accordingly condoned. 5.
Office to register the appeal.
