Heard Mr. Chinmay Patil, learned advocate for the Applicant and Ms. Dr. A. A. Takalkar, learned APP for the Respondent State.

Applicant was directed to be released on bail by order dated 23rd January, 2025 passed in Bail Application No. 3680/2024, on the bail conditions referred in paragraph Nos. 6(i) to (iv), which reads as under :- "(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No. 271 of 2022 registered at Chikhali Police Station, District: Pune for the offences
punishable under Sections 376(2)(n) and 328 of the Indian Penal Code, 1860 and Sections 3, 4(a), 5(j) (ii), 6, 7 & 8 of the POCSO Act on executing P.R. Bond in the sum of Rs.15,000/- with one surety in the like amount;
(iii) The applicant shall not contact the victim. (iv) Application stands disposed of accordingly." 3.
By the present Application, the Applicant has sought for relaxation of furnishing surety of sum of Rs.15,000/- till his release. Prayer made by the Applicant in the present Application is at paragraph No. 14 (a) which reads as under :- "14(a). Relax the condition imposed in clause (ii) of the order dated 23rd January 2025 in Criminal Bail Application No. 3680 of 2024 and permit the Applicant to be released on deposit of cash surety of Rs.15,000/- in lieu of furnishing surety."

Mr. Chinmay Patil, learned advocate for the Applicant states that the Applicant will furnish the regular surety within a period of 60 days from his release.

Ms. Dr. A. A. Takalkar, learned APP for the Respondent State has no objection.

It is disturbing to note that the Applicant despite being
ordered to be released on bail, by order dated 23rd January, 2025, h is in jail for almost six months. Application for relaxation is placed before this Court, today.

Be that as it may, Applicant is permitted to deposit cash surety of Rs.15,000/- in lieu of furnishing surety. Applicant shall furnish surety within a period of 60 days from his release. 8.
Interim Application is allowed.
