The Applicant seeks modification of conditions (iii), (vi) and (vii) of the order dated 19th December 2024. The said conditions read thus:

"(iii)After release on bail, the Applicants shall not enter the village Pogaon, Taluka : Bhiwandi, District : Thane Rural, till conclusion of this Sessions Case of which, the trial is going on.

(vi) The Applicants not to leave the territorial limits of the Thane District till conclusion of the trial of the Sessions Case No.221 of 2023.

(vii) The Applicants to give attendance on every Monday from 10.00 to 12.00 noon to the nearest Police Station within the local limits of which, they are going to stay during this period."

Heard Mr. Misbaah Solkar, learned counsel for the Applicant and Ms. Anuja Gotad, learned APP.

Mr. Solkar has invited my attention to the order dated 28th February 2025, whereby condition (vi) was already substituted. The substituted condition reads thus: "(vi) Applicant is permitted to leave territorial limits of Thane District with permission of Sessions Court." 4.

Mr. Solkar further submits that the stage of trial is that the statement of the accused under Section 313 of the Cr.P.C. has been recorded one and half year ago. In these circumstances, she submits that conditions (iii) and (vii) are causing prejudice to the Applicant.

For the reasons mentioned in the Application, I am inclined to delete conditions (iii) and (vii) and it is ordered

accordingly. Condition (vi) shall remain as modified by the order dated 28th February 2025.

The present Interim Application is partly allowed and disposed of accordingly.
