This is an Application for condonation of delay of 350 days in filing the Appeal against the judgment and order dated 3.5.2024 passed by the learned Special Judge under POCSO Act, Greater Mumbai in POCSO Special Case No.381/2019.

Heard Mr. Shilpan Gaonkar, learned counsel for the Applicant and Ms. Sangita Shinde, learned APP for the Respondent-State.

Learned counsel for the Applicant submitted that the Applicant is in custody from 20.4.2019. He is from a poor financial background. He could not engage a private Advocate to file his Appeal. The Appeal is filed with the help of Legal Services Authority of this Court. Some time was lost in collecting the papers, preparing the Appeal and filing it. Therefore, there is a delay of 350 days in filing the Appeal.

Learned APP does not have serious objection for condonation of delay.

Considering these submissions and in the interest of justice, delay of 350 days in filing the Appeal is condoned. The Appeal be processed further. Interim Application is disposed of accordingly.
