By way of this Application, the Applicant seeks modification of the order dated 21st September, 2017, to the extent relaxing the condition requiring the Applicant to attend the concerned Police Station on the first Saturday of every month between 10:00 a.m. to 12:00 noon, until the conclusion of the trial.

Ms. Solanki, learned counsel for the Applicant, submits that for the past 7 years the Applicant has been attending the Police Station regularly and has never violated any of the condition of bail. However, she submits that for the past 7 years Prosecution Witness is yet under examination. She submits that Prosecution Witness has delayed the trial on flimsy grounds and does not attend the trial, hence, the trial is at standstill. In these circumstances, she prays that the said condition to attend the Police Station concerned be relaxed. 3.
I have heard Ms. Malhotra, learned APP representing the State. She fairly concedes that charges are framed and trial has commenced.

Considering the averments made in the Application and the status of the case as of date, I am of the view that the interests of justice will be subserved, if the Applicant is directed to remain present on each and every date of the trial Court and condition (iii) of paragraph No.6 of order dated 21st September, 2017 is relaxed.

Accordingly, condition (iii) of paragraph No.6 of order dated 21st September, 2017 stands modified to the above extent. Rest of the order shall remain as it is. 6.
Considering that trial is pending for the past 7 years, the Trial Court is requested to expedite the trial. 7.
Interim Application is allowed in the aforesaid terms and is disposed of.
