This is an Application for condonation of delay of 1322 days in filing the Appeal against the Judgment and Order dated 05/10/2021 passed by the Sessions Judge, Nashik in Sessions Case No.119 of 2019. The Applicant was convicted for commission of the offence punishable under Section 302 and 341 of the Indian Penal Code ("I.P.C.") and major sentence imposed on him was to suffer imprisonment for life. 2.

The learned Counsel for the Applicant submitted that the Applicant is in custody since December 2018. He is in a poor financial condition. There is no male member in the family to look after his interest. H. C. Shiv 1/2

9.ia2565.25.doc Considering the weak financial condition, he had to file this Application with the help of the Legal Services Authority of this Court. 3.

The learned APP does not have serious objection for condonation of the delay.

We have considered these submissions. Thought the delay is inordinate, however, considering the submissions made by the learned Counsel for the Applicants and in the interest of justice, the delay of 1322 days is condoned. The Appeal be processed further. 5.

Application is disposed of.
